Settlement Terms in a Divorce

Whenever a settlement in a divorce is reduced to writing, it is important to read and understand the entire agreement. The terms of the agreement may be enforceable even if they are contrary to law. For instance, if the agreement states that attorney fees will only be awarded to the prevailing party for future litigation, the court is precluded from awarding attorney fees on a needs based basis. In addition, if the property is not divided equally, the court is usually precluded from re-opening the case to make an equal division.
