If one or both spouses owned a business during the marriage, the court will divide the equity of the business in half. Generally what this means is that the value of the business will need to be divided and awarded equally to both parties.

In some circumstances the partners may own real estate that is subject to division. If it is community property it will be divided equally. However, many times the real estate consists of both community property and separate property. In those circumstances it may be necessary to hire an expert to determine the community interest subject to division.
